Terms & Conditions
1. Acceptance of Terms
By downloading, installing, or using the SourMango Nomads mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User", "you") and Sour Mango Limited ("Company", "we", "us", "our"), a company registered in Hong Kong S.A.R.
2. Eligibility
To use the App, you must:
- Be at least 16 years of age
- Have the legal capacity to enter into a binding agreement
- Not be located in Hong Kong S.A.R. (the App is not available in this jurisdiction)
- Not have been previously suspended or removed from the App
3. Account Registration
To access certain features, you must create an account by providing accurate, current, and complete information. You may register using your email address or through third-party authentication services (Google Sign-In, Sign in with Apple).
You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account. Each user may maintain only one account.
4. Description of Services
The App provides the following services:
- Destination Discovery: Browse cities and countries with information on cost of living, safety, weather, and nomad community
- AI Trip Planning: AI-generated travel itineraries and recommendations
- AI Travel Assistant: Chat-based travel advice powered by artificial intelligence
- Visa Information: Visa requirements based on passport nationality, visa tracking and expiry alerts
- Travel Tools: Currency conversion, real-time translation (text, speech, and image-based), weather information, WiFi speed testing
- Social Features: Connect with other travelers ("mates"), direct messaging, community travel posts, location sharing
- Flight Search: Search and compare flight prices
- Travel History: Track countries and cities visited with an interactive globe
- Packing Lists: Smart packing lists tailored to destinations
Services may be modified, suspended, or discontinued at any time without prior notice.
5. Biometric Authentication
The App offers an optional biometric lock feature that uses your device's built-in biometric system (Face ID, Touch ID, or fingerprint) to restrict access to the App on your device.
- Biometric authentication is processed entirely on your device by the operating system. We never access, collect, or store your biometric data.
- We only store a preference flag on your device indicating whether you have enabled this feature.
- You can enable or disable biometric lock at any time in Settings > Security.
- If biometric authentication fails or is unavailable, you can still access the App by signing in with your credentials.
6. Ripe Membership (Premium Subscription)
- Ripe Membership is a recurring subscription available through the Apple App Store or Google Play Store
- Payment is processed through the applicable app store (Apple or Google)
- Prices are displayed in your local currency and may vary by region
- You may cancel at any time through your app store account settings
- Refunds are governed entirely by Apple App Store or Google Play Store policies — we do not process refunds directly
- Free trials automatically convert to paid subscriptions unless cancelled before the trial expires
- We reserve the right to change subscription prices; changes take effect at the start of the next billing period following notice
7. User Content
Ownership
You retain all ownership rights to the content you create and post through the App, including travel posts, photos, videos, comments, and messages ("User Content").
License Grant
By posting User Content, you grant Sour Mango Limited a non-exclusive, royalty-free, worldwide, transferable, sub-licensable license to use, display, reproduce, distribute, and make available your User Content solely for the purpose of operating, providing, and improving the App. This license ends when you delete your User Content or your account, except where your content has been shared with other users and they have not deleted it.
Content Responsibilities
You are solely responsible for your User Content. You represent that you own or have the necessary rights to post the content, that it does not infringe third-party rights, and that it complies with these Terms and applicable laws. We reserve the right to remove content that violates these Terms.
8. Prohibited Conduct
You agree not to:
- Use the App for any unlawful purpose or in violation of any applicable laws
- Post content that is defamatory, obscene, threatening, harassing, or discriminatory
- Impersonate any person or entity, or misrepresent your affiliation
- Upload viruses, malware, or any harmful code
- Attempt to gain unauthorised access to the App, other accounts, or our systems
- Scrape, crawl, or use automated means to access or collect data from the App
- Interfere with or disrupt the App's functionality or servers
- Stalk, harass, or harm another user
- Reverse engineer, decompile, or disassemble any part of the App
- Use the AI features to generate harmful, illegal, or misleading content
- Circumvent any technological measures designed to protect the App or its content
9. Enforcement and Termination
We may take the following actions for violations: warning for minor or first-time violations, suspension of access, or permanent termination of your account. We may skip stages for serious violations.
You may terminate your account at any time via App settings or by contacting us at privacy@sourmango.ai. Upon termination, your data will be handled per our Privacy Policy (deleted within 30 days). Active subscriptions should be cancelled through your app store to avoid further charges.
10. Intellectual Property
The App, including its design, code, features, logos, trademarks, and all content provided by us (excluding User Content), is the exclusive property of Sour Mango Limited and is protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use.
11. Third-Party Services & AI Content
The App integrates with third-party services including Google (Maps, Sign-In, Gemini AI, Firebase), Apple (Sign in with Apple), RevenueCat, Amadeus, and Travelpayouts. Your use of these services is subject to their respective terms and privacy policies.
AI-generated content (via Google Gemini) is provided for informational purposes only and may contain errors or inaccuracies. You should independently verify any information before relying on it, particularly regarding visa requirements, safety, and travel regulations.
Cost-of-living estimates, safety ratings, healthcare scores, and other destination data are approximate, derived from aggregated data sources and AI analysis, and may not reflect current local conditions. These figures are updated periodically but may differ from actual costs at any given time.
Country and territory listings within the App are for informational purposes only and do not represent a political position on sovereignty, borders, or territorial disputes.
12. Disclaimers
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or secure; that results will be accurate or reliable; or that cost-of-living estimates, safety ratings, visa information, flight prices, or travel data is current or complete. We are not a travel agency, airline, accommodation provider, or visa processing service. You are solely responsible for your travel decisions and safety.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOUR MANGO LIMITED'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM. IF YOU HAVE NOT PAID US ANYTHING, OUR LIABILITY SHALL NOT EXCEED USD $50.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
14. Dispute Resolution
Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us at privacy@sourmango.ai and attempt to resolve the dispute informally for at least 30 days.
Arbitration
If the dispute cannot be resolved informally, it shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under its Administered Arbitration Rules, by a single arbitrator, in English, seated in Hong Kong.
Exceptions
Intellectual property claims, emergency injunctive relief, and small claims are excluded from arbitration.
Class Action Waiver
TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to its conflict of laws principles.
16. Indemnification
You agree to indemnify, defend, and hold harmless Sour Mango Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in connection with your use of the App, violation of these Terms, or infringement of third-party rights.
17. Modifications to Terms
We may modify these Terms at any time. When we make material changes, we will update the "Last Updated" date and notify you through the App or via email. Your continued use of the App after any modifications constitutes your acceptance of the revised Terms.
18. General Provisions
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and Sour Mango Limited regarding the App.
- If any provision is found to be unenforceable, the remaining provisions continue in full force and effect.
- Our failure to enforce any right or provision shall not constitute a waiver.
- You may not assign your rights under these Terms without our prior written consent.
- We shall not be liable for failures due to force majeure (natural disasters, pandemics, war, government actions, internet disruptions).
